CONSUMER DATA PRIVACY - Note from Rep. Elkins

"The 2021 version of the Minnesota Consumer Data Privacy Act will be introduced in the MN House of Representatives on Monday afternoon by Rep Noor and I and a “File Number” will be assigned at that time. The text of the bill as it will be introduced is attached. Like last year, the bill is a “Minnesota-ized” version of Washington Senator Reuven Carlyle’s current bill, SB5062, as it was introduced. It should also be quite similar to the bill that was just passed in the State of Virginia, HB2307 , which is also based on SB5062.

Most of the substantive language in the Minnesota bill will be adopted verbatim from SB5062 (with references to Washington statutes in SB5062 changed to references to the equivalent Minnesota statutes instead). The only significant difference is in the definition of “specific geolocation data”. Last year, a number of you told me that the arbitrary 1/3 mile circle used in the Washington bill was impractical to implement and, upon reflection, I had to agree. This definition has been generalized in the Minnesota version of the bill.

For 2021, Senator Carlyle adopted a number of definitions from the new California Privacy Right Act (CPRA) which was adopted by California voters in November. Facial recognition was broken out into a separate bill (Rep Mohamud Noor will be authoring a separate Facial Recognition bill, here). There are no other substantive changes that I’m aware of to the basic rights established in last year’s version of the bill.

Monday at noon, the Minnesota chapter of the International Association of Privacy Professionals (IAPP) is hosting a webinar in connection with the introduction of the bill and there will be an opportunity to ask questions and discuss the bill. Reference: Elkins e-mail on data privacy legisaltion

"Earlier this week, Washington State Senator Reuven Carlyle introduced the 2021/22 session version of his Washington Privacy Act, SB5062. We received a copy of this new version of his bill on Wednesday from his office (we expected to have it a month ago).  It is currently in the hands of House Research analyst Nathan Hopkins, who is already in the process of “Minnesota-izing” the bill, which will probably take him a week or two. As soon as we have a good draft of the bill, we will circulate it to you for comment. (It will probably take us another week to get it through the logjam in the Revisors Office.) Representative Noor will be my partner and co-author on this initiative.  If you want to get a head start on your review, you can read the original WA version of the bill at the bill link, above. Feedback from your colleagues in Washington is also welcome.

We’ll be hewing quite closely to the wording of Carlyle’s bill because one of our objectives is to avoid the proliferation of unique state level bills (in the absence of Congressional action) and almost all of you have told me that Carlyle’s bills provide a better template than the California legislation. It’s my understanding that this bill is being introduced in New York, as well. In this iteration, Carlyle has changed a number of definitions to align them with the definitions found in the new California Privacy Act, which was passed by California voters in November.

The one difference that I know of between his bill, as introduced, and our bill, as it will be introduced, relates to geolocational data privacy. Many of you told me that the provision in our bill last year (with the 1/3 mile radius) was impractical to implement.  Putting on my old Data Architect hat, I had to agree (I couldn’t think of a way to represent it in a database). So, the language that we’ll be using is more general:

12  (30) "Specific geolocation data" means information derived from

13  technology including, but not limited to, global positioning system

14  level latitude and longitude coordinates or other mechanisms

15  that can be used to identify a natural person's specific location..

16  Specific geolocation data excludes the

18  content of communications.

… and we have provided this suggested language to Sen Carlyle, as well. This language was suggested by Damien Rehl, the co-chair of the Data Committee of our Governor’s Council on Connected & Automated Vehicles. Depending on the context, there are lots of ways to meet this goal, but drawing an arbitrary circle around a point isn’t a practical one.

Nathan will be changing references to Washington Statutes in Carlyle’s bill to references to the equivalent Minnesota Statutes, and including other integrations with existing Minnesota Laws such as those you saw in HF3936, last year, but those will be the only significant differences between our new bill and Carlyle’s new bill.

Like Carlyle’s bill, ours will not be introduced with a Private Right of Action. However, we know that this issue will be in play during the committee hearing process and we are planning for a related amendment to be introduced and discussed when the bill gets to the Judiciary & Civil Law committee.

      6. The Department of Civil Rights shall be responsible for enforcement of the minimum wage ordinance.
      7. Report back to City Council on mechanisms for implementation of additional staff recommendations from the “Staff Report on a Minimum Wage Policy,” including:
      8. Funding a regular review of the minimum wage ordinance, including an annual evaluation of the impact on the local economy, and an examination of how the policy implementation specifically impacts tax receipts, wages, and unemployment rates of Minneapolis workers; and
      9. Identifying ways to support businesses and smaller business in particular.
